The Will of Howard Elkington 1835-1898

 

Howard Elkington of Leeswood near Mold in the County of Flint left his wife Annie Elizabeth £1000 to be paid direct after his death plus use of everything he owned as well as £800 paid quarterly each year.  Howard also made a special Trust for his daughters and Annie Elizabeth Elkington, his wife was the Trustee and Executer.

Special clause: if any daughter died without issue her share goes back to the Trust, not given to her husband.

 

Howard Elkington appointed his 3 brothers Frederick, James Balleny and Hyla his Trustees and Executors.  Messrs. W. Watson & Rutherford Solicitors the Clerk was Andrew McGowan.

 

Howard requested his Trustees to sell and convert into money his real estates, he also requested to retain his share in the Elkington & Co Ltd (as an investment to his Estate) – Buy Public Stocks or Bonds of  Great Britain or free hold long leasehold securities in England and Wales. 

Debentures or preference stock or guaranteed stock of London N. Western Railway/Midland

Railway, Great Western Railway or North Eastern Railway (but in no other mode of investment).

 

Special Request his mother-in-law, Elizabeth Armstrong to be paid £100 quarterly but if she re-married the amount to be transferred to her daughter Jessie Catherina Armstrong as long as she was unmarried.

 

The Trust Fund shall be held in Trust for all Howard Elkington’s (1835-1898) children and their heirs only.

At the death of all the 3 appointed Trustees and Executers Frederick Elkington, James Balleny and Hyla by 1907;            Ernest Howard Armstrong Elkington & his Mother, Annie Elizabeth Armstrong Elkington became the sole Trustees and Executers of Howard Elkington’s 1898 Trust and the Family Estate.  The Solicitors were Francis John Gamlin and Hugh Cyril Kelly both of Rhyl.

 

Probate of Howard Elkington’s Will was dated 21 day of Feb 1899, Executor of the Will Frederick Elkington, James Balleny and Hyla.
